Terms of Service
Last updated: November 1, 2026
These terms are an agreement between you and OTHEX CORP, a Florida corporation, 5645 Coral Ridge Drive, Suite 137, Coral Springs, FL 33076 ("we", "us"). We run dtaas.com. By creating an account, sending a fax or paying us, you agree to these terms, our Privacy Policy, our Acceptable Use Policy and our Refund Policy. If you don't agree, please don't use the service.
1. What the service is
dtaas.com sends faxes for you. You upload files, we turn them into fax pages, dial the number you give us, and tell you whether the fax was delivered.
- The service is outbound only. We can't receive faxes, so nobody can fax you back through us.
- We send to the numbers listed on the Send page. We may add or remove destinations.
- The service is offered as is and as available (see section 9).
2. Accounts and guests
- You must be at least 18 and able to make a binding contract. If you use the service for an organization, you confirm you may bind it.
- There are no passwords. You sign in with a link we email you, and you can send one fax as a guest. We still create an account for your email address.
- Give us a real email address that you control. Anyone who can read that inbox can use your account. That includes deleting it, which gives up any credit left on it. Keep it secure. Tell us right away at help@dtaas.com if you think someone else has access.
- You are responsible for what happens under your account.
3. Prices, balance and charges
- Price. 20¢ (US) for each page that is delivered. The cover page, redials within the 6-hour window and the delivery receipt are free. All prices are in US dollars. The price includes any tax. We cover it, and nothing is added at checkout.
- Prepaid credit. When you add money, you buy prepaid fax credit. We also call it your balance or your wallet. You add money by card, through Stripe. The smallest top-up is $10 and the largest is $500. Your balance is prepaid credit for faxes at our prices. It is not a bank account, earns no interest and can't be transferred to another person or account. Credit doesn't expire with time. It ends only if the account is deleted or closed, we stop offering the service, or your bank reverses the payment it came from (see sections 7 and 8).
- Money held. When you confirm a fax, we hold the most it can cost (the number of pages times 20¢) from your balance. If your available balance is too low, we won't send it. You can add money and try again.
- Charged once, only when delivered. We charge you only if every page of the fax is delivered, and only once. If the final status is "Not delivered," "Delivery not confirmed" or "Canceled," the money held goes back to your balance and you pay $0. Requesting cancellation does not stop a call already under way. If that call delivers the whole fax, it is charged. We never charge for part of a fax.
- The price you see is the price you pay. We may change our prices at any time, and you owe nothing extra because of a change. A change applies only going forward, to faxes you confirm after it takes effect. The price shown on the confirm screen is the one that applies to that fax. Credit you already have stays as credit in your balance: a price change never turns it into a set number of pages.
- All top-ups are final. Credit is not refundable and can't be exchanged for cash, except where the law requires it. We refund to your card only in the cases listed in the Refund Policy, such as a charge we made by mistake or a guest's only fax whose final status is "Not delivered," "Delivery not confirmed" or "Canceled." Deleting your account, or our closing it or stopping the service, gives up the credit left on it (see section 8).
4. Delivery, redials and receipts
- "Delivered" means the receiving fax machine confirmed that it received every page. "Not delivered" means the whole fax did not get through. "Delivery not confirmed" means we did not get a final result and cannot tell whether it arrived. You are not charged for either "Not delivered" or "Delivery not confirmed."
- If the number is busy or doesn't answer, we redial for up to 6 hours at no charge, then stop. If a call is cut off partway, we resend the whole fax on the next try, still at no extra charge.
- If we cannot confirm delivery, we do not resend the fax automatically and do not charge you. It may already have arrived. Before using Send again, check with the recipient and confirm that it did not arrive.
- If the fax engine loses track of a fax, an administrator may close it with no charge after an extended period without updates. We record the reason, return the money held to your balance, and show "Delivery not confirmed." This does not establish whether the fax arrived. Check with the recipient before sending it again.
- You can ask to cancel before the first page starts sending or while we wait to redial. Once the fax line has the fax, cancellation takes effect when the line confirms it. Until then, the money stays held. A call already under way may still deliver the whole fax and be charged. When the final status is "Canceled," the money held goes back to your balance and you pay $0.
- Prepared previews are temporary and expire after about 23 hours. If yours expires, make and review a fresh preview before sending. Refusing an expired preview holds or charges nothing.
- You choose the number. We can't tell whether a number belongs to the person you meant. If you type the wrong number and that fax is delivered, we can't take it back, and the pages are charged.
- Receipts. When a fax is delivered we give you a delivery receipt with the details and a fingerprint (SHA-256) of the fax we sent. It is a record from our fax system. It shows that the receiving machine confirmed the pages. It doesn't prove that a particular person read the fax or that the machine's owner received it in time. It doesn't contain the fax's content.
- We don't promise how long a fax takes, how it will look on the other end, or that the receiving machine prints it well.
5. Your faxes and your fax header
- You keep all rights to what you send. You give us permission to store, convert and transmit it, and to keep it for the time in our Privacy Policy, only so we can run the service.
- The header on each page shows your name, a telephone number, and the date, time and page. You must give a true name. The number is optional, but U.S. law requires every fax to identify the sender and give a telephone number. If you leave it blank, the header shows your name followed by "via dtaas.com", with our number, so the fax still follows the rule and the recipient can see who it came from. For a name over 36 characters it reads "via dtaas", so your name is never cut short. If you give a number, it must be one where you can be reached. You stay responsible for the fax either way. If a recipient writes to us about it, we may pass the message on to you.
- We don't read your faxes as a routine matter. We may look at one if we have good reason to think it breaks the law or our Acceptable Use Policy, if you ask us for support, or if the law requires.
- Faxes travel over the public phone network, which isn't encrypted. Don't send anything you aren't willing to send over that network.
- Health information. dtaas.com is not built for HIPAA-regulated data, and we don't sign business associate agreements. If you are a covered entity or a business associate, don't send protected health information through us.
6. Rules for using the service
You agree to follow the Acceptable Use Policy. In short: no junk faxes, no harassment, nothing illegal, and no reselling of the service. We may refuse, stop or cancel any fax that breaks the policy.
7. Card disputes
If you have a problem with a charge, please write to billing@dtaas.com first. We'll sort it out quickly. If you dispute a payment with your bank or card company, we pause the account while the dispute is open. A paused account can't send faxes or take top-ups. We will send your bank the record of the payment, including your agreement to these terms and the faxes sent with that credit. Credit from a disputed payment is held. If the payment is reversed, only the credit from that payment is removed. The rest of your credit stays on your account unless we close it for fraud or abuse (section 8). A dispute on its own doesn't close your account. If some of the removed credit was already used for delivered faxes, we may ask you to pay for those pages. We lift the pause once the dispute is closed and we have reviewed the account. See the Refund Policy.
8. Suspending and ending an account
- You can stop using the service at any time and delete your account in Settings. Any credit left on it is given up when you delete it, or when you ask us to delete it, and isn't refunded (see the Refund Policy). If you deleted it by mistake, write to billing@dtaas.com within 14 days and sign in again with the same email: we restore the credit that was on it. That is a restore, not a refund. Deleted faxes and files can't be restored.
- We may suspend or close an account if you break these terms or the Acceptable Use Policy, if we suspect fraud, or if the law requires. Where we can, we tell you why. While we look into suspected fraud, we may hold the credit on the account, and we tell you. If we close an account on suspicion of fraud and later find we were wrong, we restore the credit. That is a restore, not a refund.
- A disputed or reversed payment pauses the account while the dispute is open (section 7). On its own it removes only the credit from that payment. We give up the rest of the credit only if we find fraud or abuse. If we close an account over a dispute and nothing else, it is treated like any other closure below: we give notice, we lift the pause, and you can use the credit that is left until then.
- If we close your account for a reason other than those above, or we stop offering the service, we email you at least 30 days before, unless the law or a company we depend on makes us stop sooner. In that case we tell you as soon as we can. You can keep sending faxes with your credit until then. We stop taking top-ups when we send that email. Credit left on an account when it closes is given up and isn't refunded, unless the law requires otherwise (see the Refund Policy).
- Sections that by their nature continue after the account ends (such as 3, 7, 8, 9, 10, 11 and 13) do.
9. The service as is
We work hard to deliver your faxes, but we can't guarantee the service will always be available or error-free, or that any fax will be delivered. Telephone networks, receiving machines and the internet are outside our control. To the fullest extent the law allows, we provide the service "as is" and "as available", and we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Some places don't allow some of these limits, so they may not apply to you.
10. Limits on our liability
To the fullest extent the law allows:
- We aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost deadlines, lost business or lost data, even if we were told they were possible. A fax that arrives late or doesn't arrive is a risk of using any fax service. Don't rely on us alone for anything where a deadline matters. Send it early and confirm by another route.
- We aren't responsible for how you use the service or for what you send: the content of your faxes, the numbers you send them to (including a wrong or mistyped number), whether you had the right to send them, or whether they follow the law, such as the junk-fax rules.
- We aren't liable for losses caused by failures, outages, errors, delays, lost data or security incidents in our systems or in the systems of the companies we rely on (phone carriers, hosting, payment and email providers), or by a fax that is lost, unreadable, late, cut off or picked up by the wrong machine.
- If a fax isn't delivered, your remedy is that you aren't charged for it. If you were charged by mistake, your remedy is a refund or credit of that charge.
- Our total liability for any claim about the service is limited to the amount you paid us in the 12 months before the claim arose.
- These limits apply to OTHEX CORP and to its officers, employees and the companies that help us run the service, whatever the legal theory of the claim.
Nothing in these terms limits liability that the law doesn't let us limit, such as liability for our own fraud, intentional wrongdoing or gross negligence.
11. If your faxes cause a claim
You agree to defend OTHEX CORP, its officers, employees and the companies that help us run the service, and to cover their losses and reasonable costs, including legal fees, from any claim by a third party that comes from a fax you sent, from how you used the service, or from your breach of these terms, the Acceptable Use Policy or the law. This includes claims under the federal Telephone Consumer Protection Act (47 U.S.C. § 227).
12. Changes to these terms
We may update these terms. We'll post the new version here with a new "last updated" date. For a material change, we'll also email you at least 30 days before it applies to you, unless the law requires it sooner. If you keep using the service after the change takes effect, you accept it. If you don't accept a change that makes things worse for you, write to billing@dtaas.com before it takes effect. We close your account and refund the credit left on it to your card (see the Refund Policy). Otherwise you can simply stop using the service. Price changes are the exception: the price is shown before each fax, and they work as described in section 3.
13. Law and where disputes go
These terms are governed by Florida law and applicable U.S. federal law, without regard to conflict-of-laws rules. If you and we have a dispute about these terms or the service, it goes in this order, apart from the two exceptions below:
- Talk first. Write to legal@dtaas.com and describe the problem. We'll both try to settle it for at least 30 days before anything else starts.
- Arbitration. If it isn't settled, it goes to binding arbitration before it goes to court. The arbitration is run by the American Arbitration Association (AAA) under its rules for consumer disputes (or its commercial rules if you use the service for a business), as they stand when the case starts, and you can read them at adr.org. If you are a consumer, you may take part by phone, by video or in writing, or, if there is an in-person hearing, at a location that is reasonably convenient for you, as the AAA's rules set it. Broward County is not required for arbitration. The arbitrator applies these terms and the law, and the AAA's rules decide who pays which fees.
- Courts. After arbitration, or where arbitration can't be used, the state and federal courts in Broward County, Florida, are the place to go. That covers asking a court to enforce or confirm the arbitrator's decision, a case that arbitration can't handle, and any case the AAA won't or can't take. We both agree to those courts for these steps.
One claim at a time. You and we each bring claims only for ourselves, never as a plaintiff or class member in a class, collective or representative action, and an arbitrator may not combine more than one person's claims. If a court finds this paragraph can't be enforced for a claim, that claim goes to the Broward County courts instead of arbitration, and the rest of this section still applies.
No jury. If a claim goes to court, you and we both give up the right to a jury trial, as far as the law allows.
Two exceptions. These skip the 30-day wait and arbitration:
- Either of us may go straight to court (the Broward County courts above) for an emergency order to stop misuse of the service or of someone's rights.
- Either of us may bring a claim that qualifies in a small-claims court that can hear it, without first waiting 30 days or going to arbitration.
14. The rest
- These terms, with the policies linked above, are the whole agreement between us about the service.
- If a part of these terms is found unenforceable, the rest still applies.
- If we don't enforce a term right away, that doesn't mean we gave it up.
- You may not assign these terms to anyone else without our written consent. We may assign them to a company that takes over the service.
- We aren't responsible for delays or failures caused by things beyond our reasonable control, such as network outages, carrier problems, power or internet failures, or natural disasters.
